PRIVACY AND COOKIES POLICY – effective from March 19, 2025

In compliance with Articles 12 and 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation – "GDPR"), the Data Controller hereby informs:

1. This Privacy Policy (hereinafter referred to as the “Policy”) is addressed to Users and Customers of the website available at https://storkfurniture.com (hereinafter referred to as the “Online Store”) and defines the type, scope, and purpose of data processing. The Policy is informational in nature and forms an integral part of the Online Store’s Terms and Conditions. Any capitalized terms used in this Policy have the same meaning as defined in the Terms and Conditions, unless otherwise specified herein.

2. The controller of personal data obtained through the Online Store is the Seller: tralee furniture sales stork with registered office at Discover Ballyvelly, Tralee, Co. Kerry, Ireland,

registered in the COR (Companies Registration Office) under VAT no: 4558574B Registration Number: 4558574B, hereinafter also referred to as the “Controller”.

3. By placing an order in the Online Store without registering an Account, and/or registering an Account, and/or contacting the Seller (via email, phone, or contact form), and/or using other services provided electronically (password reminder, adding Products to wishlist, submitting product reviews), the User provides the Seller with their personal data (name, address, email address, phone number, optionally company name, business address, VAT number, IP address used while browsing the Online Store or adding Products to favorites).

4. Purposes and activities of personal data processing:

4.1. Placing an order without account registration – providing data is voluntary but necessary to perform the sales agreement and deliver the order. The legal basis is Art. 6(1)(b) GDPR. Data is stored as needed to fulfill the order, and up to 5 years for tax/accounting and claims purposes (Art. 6(1)(f) GDPR).

4.2. Account registration – Data is used for account management and sales fulfillment. The legal basis is User’s consent (Art. 6(1)(a) GDPR). Data is stored while the account is active, and up to 5 years for claim defense (Art. 6(1)(f) GDPR).

4.3. Contact with the Controller – Data is used to respond to User inquiries and archived for legal purposes. Legal basis: Art. 6(1)(b) and Art. 6(1)(f) GDPR. Data is retained for up to 5 years.

4.4. Password reminder – Data is used to send password reminders. Legal basis: Art. 6(1)(b) GDPR. Stored up to 5 years (Art. 6(1)(f) GDPR).

4.5. Product search and wishlist – IP and system logs are used to display relevant content (Art. 6(1)(f) GDPR).

4.6. Analytics and statistics – IP and other data (browser, location, OS) are used to analyze activity and optimize the store (Art. 6(1)(f) GDPR). Google Analytics may be used. Data stored up to 24 months. Users may opt out via: https://tools.google.com/dlpage/gaoptout

4.7. Compliance with GPSR Regulation – Personal and purchase data is processed under Regulation (EU) 2023/988 on general product safety. Legal basis: Art. 6(1)(c) GDPR.

5. The User has the right to data portability, access, rectification, objection, and withdrawal of consent at any time without affecting the lawfulness of processing prior to withdrawal. The Controller may refuse deletion if legal grounds exist. The User has the right to lodge a complaint with the Data Protection Authority. Data is not subject to automated decision-making or transferred outside the EEA.

7. The Controller does not share, sell, or lease personal data to third parties except those indicated in this Policy and the Terms (banks, PayU, delivery companies, accounting services, hosting providers), unless explicitly consented by the User or required by law (e.g., courts, law enforcement).

8. The Controller processes data in accordance with User consent and legal requirements, including GDPR. Data is protected against unauthorized access and the Online Store uses SSL encryption.

9. The website may contain links to external sites (e.g., Instagram, Facebook). The Controller is not responsible for their content or privacy standards. This Policy applies only to the Online Store. Users should review external policies before submitting data.

10. The Online Store uses "cookies" to identify browsers. Cookies do not contain personal data. More info at: Google Cookie Types

11. Cookies are small files stored on User's computer. They improve website functionality, store preferences (e.g., cart, login), track behavior for optimization, and help prevent spam.

  1. Ensure functionality – remembering user input like cart or login.
  2. Improve performance – analyzing navigation behavior.
  3. Target promotions – customizing content to the User.

12. Cookies do not allow personal identification. No personal data is stored.

13. Cookies are safe. Users may block or delete cookies in browser settings. Instructions differ by browser.

14. Rejecting essential cookies may cause display issues. Other cookies affect functionality. Users may allow selected cookies only.

15. The Controller may amend this Policy for valid reasons (e.g., law change, order process changes). Users will be notified at least 14 days before changes take effect via the Online Store and email if applicable. Users can terminate their data agreement if they do not accept changes.
